Addressing Systemic Challenges in International Criminal Law: A Strategic Framework for Enhanced Compliance Mechanisms

Abstract

International criminal law (ICL) faces persistent challenges in achieving widespread compliance from state actors, particularly concerning the enforcement of international treaties and the prosecution of war crimes. This study employs a mixed-methods approach, combining qualitative content analysis of legal texts with quantitative surveys of legal practitioners across multiple jurisdictions. The findings reveal a significant discrepancy between state commitments and practical enforcement mechanisms, with only 30% of surveyed practitioners indicating effective compliance in their jurisdictions. These results underscore the urgent need for a strategic framework aimed at enhancing compliance in ICL through tailored national legislations, international cooperation, and robust monitoring systems. The study not only contributes to the theoretical discourse on compliance mechanisms but also offers actionable recommendations for policymakers and judicial institutions.
