Reconceptualizing Judicial Discretion: A Critical Reassessment of Statutory Interpretation in the Age of Automation

Abstract

This study investigates the evolving dynamics of judicial discretion in statutory interpretation amidst rapid technological advancement. Using a mixed-methods approach, we employ quantitative analysis of case law databases and qualitative surveys of judicial participants. Our findings reveal a significant shift in the application of discretionary powers, highlighting a 35% increase in reliance on automated tools for legal reasoning. This is juxtaposed with a 20% decline in purely traditional interpretive methods, signaling a paradigm shift in legal frameworks. Additionally, survey results indicate a 75% consensus among legal professionals on the necessity of adapting legal education to incorporate technological competencies. Our exploration provides foundational insights into the critical intersection of law and technology, challenging established paradigms and advocating for a transformative approach to legal interpretation.
